By the consent of the parties the matter is taken up beyond the regular Court hours.

The defendants in a suit for eviction are the petitioners of the instant application under Article 227 of the Constitution of India.

The said suit being Ejectment Suit No. 175 of 2016 is pending before the 2nd Bench of the Presidency Small Causes Court at Calcutta.

The learned Trial Judge by the Order No.78 dated July 24, 2024 has dismissed an application filed by the petitioners for holding local inspection of the non-suit properties on the ground that such inspection is unnecessary and is aimed to delay the disposal of the suit. This Court does not find any reason to interfere with the order impugned.

C.O. 3325 of 2024 is dismissed without any order as to costs.
