The present petition has been filed challenging the order dated 12th August, 2025 passed by the learned Additional District and Sessions Judge, Fast Track 4th Court at Barrackpore in Criminal Revision No. 464 of 2023. Learned Revisional Court dismissed the revision petition filed against the order dated 9th August, 2023 passed by the learned Judicial Magistrate, 2nd Court, Barrackpore in Misc. Case No. 597 of 2022.

Learned counsel for the petitioner submits that the learned Sessions Judge committed an error by inter alia holding that the order of the learned Judicial Magistrate was an inter locutory order. However, learned counsel limits his prayer only to the extent that an appropriate direction may be issued to the learned Judicial Magistrate, 2nd Court, Barrackpore to dispose of the Misc. Case No. 597 of 2022 expeditiously within a period of six months. 3.

In view of the submissions made, this Court considers that no prejudice would be caused to either of the parties if an

appropriate direction is issued for disposal of the Misc. case No. 597 of 2022 on merits after taking evidence of both the parties. 4.

In the facts and circumstances of the present petition is disposed of with a direction to the learned Judicial Magistrate, 2nd Court, Barrackpore to dispose of the Misc. Case No. 597 of 2022 without granting any unnecessary adjournment in accordance with law.

Learned Judicial Magistrate may endeavour to dispose of the same within a period of six months.

With the aforesaid observations, the present petition is disposed of.
