Mr. Debasis Kar Mr. Arka Tilak Bhadra Mr. Suhana Parvin ...for private respondents Petitioner stated that she is aged about 80 years 25.09.2025 Court No. 35 D/L. No.65 Rakib and her husband is aged about 85 years. It is further stated that the private respondents have thrown away the petitioner and her husband from the house.

On the other hand learned advocate appearing for the respondent nos. 5 and 6 submit that there is a development agreement for which an advantage is being sought to be taken by the parents and the main purpose is to throw away the private respondents.

As none appears on behalf of the State Mr. Bellal Shaikh, learned advocate empanelled with the State of West Bengal is directed to represent the State. His appointment may be regularized by the concerned authorities. A copy of the writ petition be handed over to the learned advocate for the State.

Be that as it may, since the prayer of the petitioner before this Court is for returning to the residence, I direct that if the petitioner and her husband approach the police authorities, police authorities would in case of inconveniences faced by the petitioner provide necessary protections. If there are complaints of subsequent harassment, police authorities would address the same. Such arrangement would continue for a period of 30 days.

In the meantime, petitioner would approach the Tribunal afresh under the Maintenance and Welfare of Parents and senior Citizens Act, 2007, if any direction is pass by the Tribunal, police authorities would respect obey and implement the said order.

With the aforesaid observations WPA 22778 of 2025 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
