Despite service none appears on behalf of the respondent authority.
The Sub-Divisional Controller, Food and Supplies, Malda & Post Office and District-Malda published one advertisement for appointment of FPS (Ration) Dealership at Mojampur, near Pirojpur Idgahatola Primary School, Village and Post OfficeHaruchak, Police Station-Kaliachak, District- Malda vide memo No.
510/SCF (M)/2024 dated 17.05.2024.
In pursuance to the said advertisement the petitioner made an Online application on 23.08.2024. He has submitted all the relevant documents showing the proposed godown cum shop room of the petitioner.
After receiving such applications the authority concerned has made inspection at the proposed godown cum shop room of the petitioner on 19.09.2024. Since then the
petitioner has not received any information from the authority concerned. Though, he has several times tried to get such information regarding such vacancy. Thus, he filed the instant writ for necessary direction upon the authority concerned. Heard the learned counsel for the petitioner also perused the prayer in the writ petition along with annexures thereof it appears to me that the online submission of the application was made by the petitioner on 23rd August, 2024. Thereafter, the inspection was held at the godown and shop room of the petitioner on 19.09.2024.
By virtue of the provisions laid down in Clause 20(IIIa) of WBPDS (MSC) Order, 2013, regarding the particulars of period within which the new vacancy would be filled up. It appears that the authority concerned has not acted according to the provision. Thus, I think it necessary to pass a specific direction.
Under the above observation, the instant writ petition is disposed of.
The petitioner is directed to submit a detail representation to the authority concerned within 8th November, 2024. On such representation the respondent No. 3, the Sub-divisional Controller Food and Supplies, Malda shall take appropriate decision after hearing the petitioner within 13th November,
2024. The decision of the authority must be intimated to the petitioner within 2nd weeks of December 2024.
Under the above observations, the instant writ petitioner being WPA 23409 of 2024 is disposed of.
