Mr. Sandip Chakraborty .....For the State The present revisional application was preferred challenging the proceeding relates to Siliguri P.S. Case No.114 of 2005 dated 24.04.2005 including the order passed in the application under Section 156(3) of the Code of Criminal Procedure (Misc. Petitioner Case No.87 of 2004). Records of the revisional application reflects that there was no interim order in respect of either the investigation proceeding or proceedings pending before the Learned Magistrate.

Having regard to the fact that the revisional application was instituted in the year 2005 and almost 17 years have passed in the meantime, I am of the opinion that no interference at this stage after lapse of time is warranted. Learned Magistrate would abide by the report under Section 173 of the Code of Criminal Procedure filed by the Investigating authorities.

Mr. Chakraborty, learned advocate appears on behalf of the State.

Accordingly, CRR 3366 of 2005 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order, if any, stands vacated.
