Learned advocate appearing for the petitioner is directed to serve copy of this revisional application upon Ms. Manisha Sharma, learned advocate, who ordinarily appears for the State. Her appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with Cyber Crime Police Station Case No. 04 of 2020 dated 25.02.2020 and the trial of the case till date has not progressed in spite of the fact that charge has already been framed. Learned advocate submits that prosecution has relied upon seven witnesses, but till date as no witness has been examined, there has been no progress in the case. Having regard to the anxiety expressed by the petitioner, I am of the view that the same is not unwarranted. Accordingly, the learned trial court is directed to fix at least one date in every two months so that trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties.

In case any witness is reluctant to appear on the date so fixed, the learned trial court would communicate with the Superintendent of Police/Additional Superintendent of Police/DSP of the concerned jurisdiction, who is in-charge of Cyber Crime Police Station, for ensuring the presence of the witnesses or in the alternative, a compliance report be submitted by the superior officer before the learned Chief Judicial Magistrate, Krishnagar, Nadia.

Learned public prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the dates so fixed for examination of the witnesses.

All stakeholders would cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, the revisional application being CRR 3626 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
