Adv., Mr. Ganga Prasad Mukherjee ...for the State Mr. Tapadip Gupta ...for the respondent no.4 The petitioner complains that the private respondent who is the brother-in-law of the petitioner is obstructing the construction of the boundary wall of the petitioner and trying to disturb the peaceful possession thereof. She also claims that she was assaulted by the private respondent.

The Samsherganj Police Station has submitted instructions dated 11.12.2022, addressed to the learned Government Pleader. On the petitioner's complaint an enquiry was made and proceedings under Section 107 of the Cr. P.C. have been taken out. The parties have been warned against any violence.

The Samsherganj Police Station shall ensure that there is absolutely no breach of peace in the area and shall continue strict vigil thereat. The petitioner may take out appropriate civil proceedings against the private respondent in respect of a civil right arising out of the property. With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.
