It appears that notice could not be served on the private respondents on the ground of insufficient address. However, learned counsel for the petitioner submits that the petitioner and the private respondents stay in the same locality and somehow they have been able to avoid service.

Report filed on behalf of the State is also taken on record.

Learned counsel for the petitioner submits as follows. The petitioner had purchased the property in question with a view to run a school from there. He also contacted the ICDS Authority for such purpose. The school is running from the said premises. However, the private respondents started to slaughter cows and sell meat from inside the said premises. This was brought to the notice of the police for intervention

but the same was not done.

Learned counsel for the State relies on the report and submits as follows. First, no such school is running at the said premises. In fact, no permission for such purpose was granted by the ICDS Authority. Even the Panchayat Authorities have stated that they have not granted any permission for any construction on the said premises. Inquiry revealed that no such slaughtering of cows taking place from inside the said premises.

As would be evident from the above, the petitioner has not been able to make out a case for seeking an intervention by this Court.

Accordingly, no further order need be passed in this regard.

The writ petition is disposed of without any costs. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
