1. Affidavit-of-Service filed in Court today is accepted and directed to be kept with the record. The Court notes that notice has been duly served upon the necessary respondents.

2. Heard learned Counsel for the respective parties at length.

3. The present Writ Petition has been preferred by a convict who is stated to be presently languishing in custody for a period of more than 19 years, 2 months, and 29 days.

4. Learned Counsel for the Petitioner submits that the Petitioner was recommended for premature release in the proceedings of the 74th meeting of the State Sentence Review Board (SSRB), West Bengal, held on

02.06.2025, yet the Petitioner has not been released till date.

5. It is submitted that the Board's recommendation considered the satisfactory conduct of the Petitioner both in the Correctional Home and while on parole. This submission is supported by the Conduct Certificate issued by the Superintendent, Midnapore Central Correctional Home, Paschim Midnapore, annexed at page-25 of this Writ Petition, from which the Petitioner's conduct is found to be satisfactory.

Upon perusal of the record and considering the fact that the Petitioner's case for premature release has been affirmatively recommended by the SSRB, and further, having regard to the Petitioner's long period of incarceration and satisfactory conduct, this Court is of the considered opinion that the concerned authority ought to take a final decision in light of the said recommendation without any further delay.

7. Accordingly, the Respondent Authority No. 2 is hereby directed to take necessary steps in the light of the recommendation made by the State Sentence Review Board in its 74th meeting dated 02.06.2025.

8. The said Respondent shall communicate the final outcome of the decision taken on the SSRB's recommendation to the Petitioner within a period of three months from the date of this Order.

9. The Writ Petition being WPA 22799 of 2025 is thus disposed of in terms of the aforesaid direction. 10.

There shall be no order as to costs.
