Heard learned counsels for the parties.

A title suit is pending by and between the petitioner and the private respondent wherein an order of temporary injunction has been granted by the learned Trial Court directing the parties to maintain status quo in respect of the suit property with regard to its nature and character till disposal of the suit.

Learned counsel for the petitioner submits that the petitioner has filed an application under Section 151 of the Code of Civil Procedure before the learned Trial Court seeking police assistance for implementation of the said order.

The petitioner alleges that despite the said order, the private respondents are entering into the property and threatening the petitioner with dire consequences.

Complaints have been lodged by the petitioner in this regard before the police authority.

Learned counsel for the State submits that pursuant to the complaints lodged by the petitioner, the police is keeping strict vigil in the area to avoid any untoward incident and is maintaining peace and tranquility. The police has also initiated a case under Section 329(3)/223(a)/351(3)/3(5) of the BNS pursuant to the complaint lodged by the petitioner.

In view of the above, nothing further remains to be adjudicated in the writ petition and the same is accordingly disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
