We have heard the learned advocates for the parties. 2.

In our considered view the learned Single Bench was right in making certain observations in disposing of the writ petitions and leaving it open to the parties to agitate their rights before the civil Court. Thus, we find no ground to interfere with the impugned order. However, if the appellants desire to take permission without prejudice to their right and contention, they may submit written request to the writ petitioner, which shall be considered by him.

In the result, the appeal and the connected applications are disposed of.
