In this writ petition the petitioner has prayed for relief of directing the respondent concerned to release the premises No. 11, Netaji Subhas Chandra Bose, Road, Kolkata 700 040.
It appears from records that in this writ petition order was passed on 27th November, 2019 directing the First Land Acquisition Collector, Kolkata to file a report and such report dated 3rd January, 2020 has been filed in the form of affidavit. In paragraph 12 of the said report it has been recorded as follows:
"The Deputy Inspector General of Police, CID, West Bengal in response to memo no. 809LA dated 06.12.2019 of the Respondent No. 3 has sent two letters being Memo No.
195/Law/CID/429 dated 17.12.2019 and Memo no. 01/Law/CID/429 dated 02.01.2020. While in the first memo he did not mention any specific view about Direct Purchase of the land in the absence of any operational act of acquisition, in the latter memo he informed that CID had decided not to retain the premises No. 11, N.S.C. Bose Road, Kolkata - 40 (Retreat) and that it
wants to relinquish the said property within one month. All the copies of communications are enclosed herewith for ready reference."
Mr. Chandi Charan De, learned Additional Government Pleader in his fairness submits that in view of the aforesaid record and pursuant to the report of the Land Acquisition Collector, the land in question should be released in favour of the petitioner within one month. On perusal of the relevant records and considering the submission of the parties, this writ petition is disposed of by directing the First Land Acquisition Collector, Kolkata/respondent no. 3 to complete the process of releasing the premises in question in favour of the petitioner within one month from the date of communication of this order. WPA 20939 of 2019 is accordingly disposed of. (MD. NIZAMUDDIN, J.)
