Petitioner has preferred the instant writ petition being aggrieved by the alleged inaction on the part of the respondentWBSEDCL in compensating him for the loss sustained by him due to the collapse of an electricity pole of WBSEDCL over his solar panel system installed at his premises on 06.05.2025.

It is the case of the petitioner that a solar panel, installed at their premises just two months ago at a significant cost, was severely damaged on 06.05.2025 when an electricity pole suddenly broke and fell on it. As a result, the petitioner suffered a substantial financial loss amounting to Rs. 3,58,000/-.

Learned Advocate for the State submits that an efficacious alternative remedy is available to the petitioner, whereby he may prefer a representation before the District Magistrate, Paschim Medinipur. It has been further assured that upon such representation, the District Magistrate shall duly consider the petitioner's grievance in accordance with law.

4. Upon consideration of the submissions advanced and the materials placed before this Court, it is deemed expedient and

just to grant the petitioner the liberty to ventilate his grievance before the District Magistrate, Paschim Medinipur (Respondent No. 2). Accordingly, the petitioner is directed to file a comprehensive representation before him within a period of two weeks from the server copy of this order. The District Magistrate is directed to decide the representation of the petitioner forthwith thereafter preferably within a period of six weeks from the date of filing of the representation after granting an opportunity of personal hearing to the petitioner.

5. With the aforesaid directions, the writ petition is disposed of.

6. There shall be no order as to costs.

7. Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking. (Gaurang Kanth, J.)
