The grievance of the petitioner is directed against the refusal of the respondent no. 2 to accept the application of the petitioner.
It is alleged that the respondent no. 2 has refused to accept the application under Section 5(3) of the West Bengal Thika Tenancy (Acquisition and Requisition) Act, 2001 and the Rules framed thereunder. On this ground, the petitioner has approached this Court directing the respondent no. 2 to consider and dispose of the application of the petitioner.
On behalf of the State respondents, it is submitted that the petitioner has an alternative efficacious statutory remedy under the West Bengal Land Reforms and Tenancy Tribunal Act, 1997 and this writ petition is not maintainable.
In view of the submissions made on behalf of the parties, WPA No. 22948 of 2022 stands disposed of by directing the respondent No. 2 to consider and dispose of the application proposed to be filed by the petitioner in accordance with law within a period of twelve weeks from the date of passing of this order.
It is made clear that there has been no adjudication on the merits of this case and both the question of maintainability and merits of the proposed application to be filed by the petitioner before the respondent no. 2 are left open.
There shall be no order as to costs.
