Heard learned advocates appearing for the parties. By this writ petition, petitioner has challenged the impugned demand dated 17th October, 2014 as appears at page 41 to the writ petition relating to assessment years 2008-2009 and 2009-2010. Petitioner submits that against the aforesaid demand, petitioner is enjoying the interim order of stay by the Tribunal dated 5th January, 2015.

Considering the facts and circumstances of this case, I am not inclined to entertain this writ petition and grant any relief except observing that if petitioner is protected by any such interim order and the said interim order if it is still in force, in that event, all legal consequences will follow.

The conduct of the respondent State authorities concerned is not appreciated by this Court since the tribunal has granted stay of the demand by its order dated 5th January, 2015 but till date why the department has not taken any step for vacating the said interim order or for earlier disposal of the pending proceeding before the Tribunal.

With this observation and direction, this writ petition being WPA 22953 of 2022 stands disposed of. (Md. Nizamuddin, J.)
