The Panchayat and the private respondent are not represented despite service.
Learned counsel for the petitioner submits that the private respondent who is a member of Chowkhali Gram Panchayat, in connivance with the Pradhan of the Panchayat, is constructing a road by encroaching upon the petitioner's land without his consent. The petitioner submitted a representation in this regard before the concerned authority on 8th September, 2025 and seeks consideration of the same.
Since the petitioner claims to be the owner of the plot in question and alleges encroachment of the same by the Panchayat and the private respondent, the Pradhan, Chowkhali Gram Panchayat, being the 6th respondent herein, is directed to consider and dispose of the representation submitted by the petitioner dated 8th September, 2025 within four weeks from the date of communication of this order upon granting reasonable
opportunity of hearing to all concerned including the petitioner, in accordance with law.
The decision taken by the authority shall be communicated to the petitioner within a week thereof. No further construction shall be carried on through/on the petitioner's plot till disposal of the representation.
The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
