No accommodation is sought.

It appears that the premises in question is suffering an order of demolition dated 27th August, 2022 passed by the Executive Engineer (Civil), Building Department, Borough-I of the Kolkata Municipal Corporation.

Being aggrieved by the said order the petitioner has already approached the Municipal Building Tribunal by filing appeal BT Appeal No. 165 of 2022. The Tribunal fixed 28th September, 2022 for hearing of the stay petition.

As it appears that the petitioner has already availed the statutory remedy, accordingly no further order is required to be passed in the instant writ petition.

WPA 22956 of 2022 is disposed of.

Instruction given by the Executive Engineer (Civil) and the Assistant Engineer (Civil), Building Department, Borough-1 signed on 25th November, 2022 be retained with the records.
