The 1st Court of learned Civil Judge (Junior Division) at Sealdah, District 24 Parganas (South), has decreed Title Suit No.213 of 1992, a suit filed by the petitioner for eviction of the opposite parties from the suit property.

The said decree has been put into execution giving rise to Title Execution No.28 of 2023. The plaintiff took out an application for amendment to include the police station within whose jurisdiction the suit property is situated in the schedule of the plaint.

The learned Trial Judge by the order impugned dated August 21, 2024 has dismissed the said application.

The suit property has been described with the premises number, PIN code number, as such sufficiently identifiable. There is no need to include the police station in the description of the suit property.

The order impugned therefore does not call for any interference.

The Executing Court is requested to expedite the disposal of the execution case.

CO 3336 of 2024 is disposed of with the above observations without any order as to costs. Parties to act on the server copy of this order duly downloaded from the official website of this Court.
