Despite service of notice, the private respondent is not represented. Affidavit-of-service filed in Court today be taken on record.

The petitioner claims to have instituted a proceeding under the Maintenance & Welfare of Parents and Senior Citizens Act, 2007 for cancellation of a gift deed dated 2nd September, 2020.

The matter is pending consideration. The petitioner has been physically thrown out of his residence.

This Court, therefore, directs the Parnashree Police Station to escort the petitioner back into his residence. The private respondent shall be warned against any harm being caused to the petitioner and shall ensure that the petitioner is able to live there peacefully.

For the aforesaid purpose, the petitioner shall visit the Officer-in-charge, Parnashree Police Station at a mutually convenient date and time.

The proceedings before the Sub-Divisional Officer, South 24 Parganas in Serial no. 4503 of 2022 and Case No. 19 of 2022 are expedited.

The Sub-Divisional Officer, South 24 Parganas shall attempt to dispose of the aforesaid proceedings filed by the petitioner, in accordance with law, within a period of three months from date.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
