Petitioner has claimed release of arrear dues for sanctioning postgraduate scale of pay in his favour vide memo dated 22nd January, 2020 issued by the District Inspector of Schools (SE) Barrackpore, North 24 Parganas being respondent no. 3. It is submitted that for acquiring higher qualification higher scale of pay was granted with effect from 23rd August, 1999 by issuing memo dated 22nd January, 2020 but State-respondents have released such benefits from 22nd January, 2020 whereas petitioner is entitled to receive arrear benefits from 23rd August, 1999. It is also submitted by the learned advocate representing the petitioner on instruction that till date such arrear benefit remains unpaid.

Learned advocate representing the Staterespondents submits that on completion of formalities vide memo dated 17th August, 2022 respondent no. 3 requested the Deputy Director of School Education (GA), West Bengal for allotment of fund to release arrear dues. In view of aforesaid submissions made on behalf of the parties, writ petition stands disposed of directing the State-respondents to pay arrear benefits for sanctioning higher scale of pay in favour of the petitioner by 8 (eight) weeks from the date of communication of this order, if such benefit still remains unpaid.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
