On 4.10.2005 this Hon'ble Court observed that the appellants had preferred the appeal before the Hon'ble High Court in respect of preferring the same before the learned Sessions Judge, South 24-Parganas at Alipore. Leave was given to the learned advocate for the appellants to withdraw the memo of appeal and to file fresh appeal in the proper court.

Under such circumstances as stated above, the CRA 779 of 2004 is disposed of.

Let a copy of this order be sent to the trial court for information and necessary action.
