21. 11.08.2025 Court No.8 (Tanmoy) WPA (P)/516/2022 ORGONDA BABA BHAIRAB 17 MAUJA PATABINDA COMMITTEE AND ORS.
VS THE STATE OF WEST BENGAL AND ORS.
Dictated by Smita Das De, J.
1.
Nobody appeared on behalf of the parties when the matter was taken up even in the second call.
2.
The instant writ petition has been filed in the nature of a Public Interest Litigation (PIL), praying for the following reliefs:- "a) A writ in the nature of mandamus directing the respondents and mainly the respondent no.3 to allow the petitioners to organize a program which has been started since beginning, immediately;
b) A writ in the nature of mandamus directing the respondents and mainly the respondent no. 3 to dispose of their representations immediately, shall be before the date of dusherra 2022;
c) A writ of certiorari to directing the respondent mainly the respondent no.3 to transmit the record before this Hon'ble High Court;
d) Rule NISI in terms of prayer a) and b);
e) Interim order of Injunction restraining the respondents not to interfere of the program of his Hindu community, and to pass any further order or orders in favor of the petitioners;"
3.
The issue involved in the instant case is for running a 'puja' and 'mela' purely organized by a tribal community. The said function has been
organized uninterruptedly till 2018. Since 2018, few persons tried to divide the function for which a representation dated September 12, 2022 were made to the concerned authorities for permitting to run the show seamlessly but the said representations remained unconsidered. Hence this writ petition (PIL).
4.
Considering the aforesaid, since none appears for the parties and also the fact that the matter pertains to the year 2022, it is presumed that either the petitioners have lost interest or else their grievances have been redressed and has become infructuous by efflux of time.
5.
Accordingly, the PIL is disposed of.
6.
It is made clear that this Court has not gone into the merits of the case. The petitioners are at liberty to approach the concerned Authority by making a fresh representation if the cause still persists.
