1. This is an application for expeditious disposal of Misc. Appeal No. 145 of 2023, which is pending before the learned Additional District Judge, 3rd Court at Barasat. The Misc. Appeal arises out of an order of ad interim injunction.

2. It is submitted that the Misc. Appeal is pending from November, 2023 and the trial court records have not been received by the learned appellate court.

3. At this juncture, the court observes that the defendants had filed an application for amendment of the written statement which was disallowed by the learned trial judge. The revisional application was filed from the order of rejection of the amendment

application.

The court has permitted the defendants/petitioners, to file an additional written statement within a period of three weeks from the date of communication of this order.

Under such circumstances, this application is disposed of with a direction that, upon receipt of the additional written statement that will be filed pursuant to the order of this court, the learned trial judge will ensure transmission of the records to the court of the learned Additional District Judge, 3rd Court at Barasat within 10 days thereafter and the Misc. Appeal shall be disposed of within a month from receipt of the trial court records.

5. The time period mentioned hereinabove, is peremptory.

The revisional application is accordingly disposed of. There shall be no order as to costs.
