Petitioner is directed to serve a copy of the revisional application upon Ms. Ratna Ghosh, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. Learned advocate for the petitioners submits that the date for consideration of charges has been fixed on 22nd November, 2023. Having regard to the fact that the case was initiated in the year 2020 but till date charges have not been framed, I am of the view that the learned trial court would complete the process of consideration of charges on the next date so fixed or within a fortnight thereafter.

Learned advocate submits that there are seven witnesses in support of the prosecution case. After consideration of charges if the learned trial court is of the opinion that the trial should proceed in that case, then the learned trial court should fix at least

one date in every forty-five days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. In case, if any of the witnesses is not appearing or reluctant to appear, the learned trial court will communicate with the SDPO/Additional SP/DSP in charge of Madhyamgram Police Station would ensure regarding the presence of the witness on the dates so fixed before the learned trial court. No unnecessary adjournments should be granted to either of the parties.

The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned. All efforts be taken by the stake-holders to cooperate with the trial court so that the trial is concluded within a reasonable period of time. With the aforesaid observations, the present revisional application being CRR 3643 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
