Mr. Debasish Sur Mr. Amitava Chowdhury ..for the petitioner Mr. Suman Ghosh Mr. Suman Dey ... for the State Report submitted by the State is taken on record. It is submitted on behalf of the petitioner that the private respondents have been burning the waste of their shop under open sky which is creating hazardous situation to the petitioner and other neighbours who reside adjacent to the shop.

It appears from the report submitted by the State that the police has intervened in the matter and has initiated a specific case under Section 126/135(3) of the BNSS on September 24, 2025 to maintain peace and tranquility in the locality. The private respondents have been asked to take alternative steps for disposal of the waste of their shop.

In view of the above, the writ petition is disposed of with a direction upon the State to keep necessary vigil over the area in question for the purpose of maintaining peace and tranquility in the area.

The petitioner shall be at liberty to approach the local body for redressal of his grievance, in accordance with law.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

There shall be no order as to costs.
