It is submitted that the interpretation of Chairman of Uluberia Municipality of Settlement has been arrived at. Mr. Hussain is seeking direction to send back the lower court record with liberty to the petitioner to approach the learned trial court to record a compromise and dispose of the suit.
Ms.
Amrita Panja Moulick, learned counsel representing the State submits that State does not want to stand in the way of settlement. Therefore, I am inclined to allow the prayer. The department is directed to send down the lower court record, if the record has already been received by the department, immediately to facilitate compromise between the State and the petitioner.
The interim order passed on 15th December, 2014 shall continue till the suit is disposed of. The impugned judgment is set aside.
Thus, the revisional application is disposed of on consent.
