Petitioner is aggrieved by the inaction of the police 19.05.2025 Court No. 35 Item No.31 Rakib authorities, particularly the information which were furnished as they claimed to have been arrested and physically assaulted. The same was informed to the Police Commissioner of the Barrackpore Police Commissionerate.

A report was earlier submitted before this Court which reflects that there was a dispute between the Radio Flying Squad police personnel and the petitioner and his associates.

Petitioner complains that as a counterblast to the representation against the information submitted at New Market Police Station, the action was taken against him. The report reflects that the Officer-in-Charge of Belghoria Police Station considered all the aspects of the issues including the CCTV footages which was preserved, there were no injuries also found and the accusations relating to the snatching of the money was also found to be incorrect.

Having regard to the fact that the representation which was filed was of the year 2023, I am of the view that, in case there are materials in possession of the petitioner to rebut the contention of the police authorities, petitioner would be at liberty to prefer an application under the relevant provisions of the BNSS before the jurisdictional Court, learned jurisdictional Court will enquire into the same and assess whether any offence is made out and thereafter take steps in accordance with law.

With the aforesaid observations WPA 22670 of 2023 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
