Learned counsel for the petitioner submits that pursuant to work order issued on 22nd March, 2023 by the Pradhan, Kushbasan Gram Panchayat, the petitioner undertook construction of toilet with two septic tanks and completed the work within due time.

The Pradhan issued a letter to the Block Development Officer, Narayangarh Development Block on 27th March, 2024 intimating such completion and seeking fund for disbursement of the bills submitted by the petitioner and other contractors. The petitioner submits that his bills have not been cleared till date. The petitioner submitted a demand notice before the concerned authority through his learned Advocate on 8th August, 2024 in this regard and seeks consideration of the same.

Upon consideration of the submission made on behalf of the parties, the Pradhan, Kushbasan Gram Panchayat, being the 11th respondent herein, is directed to consider and dispose of the demand notice within six weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the concerned authority arrives at a decision in favour of the petitioner, necessary consequential steps be taken at the earliest. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
