December 22, 2022 Sri Ramchandra Sarkar Vs, Sri Narayan Chandra Debnath The matter appeared in the warning list on November 29, 2022 with a clear indication that the matter would be transferred to the daily cause list on December 5, 2022 before the relgular bench. Since then the matter is appearing in the list. The present appeal is of the year 2011.

The matter had appeared last on April 27, 2012, when a co-ordinate bench of this court on consideration of the revised report of the additional stamp reported dated January 2, 2012 directed the learned advocate for the appellant to take out an application for acceptance of deficit court fees put in out of time and to delete the dates of the decrees of both the courts below from the preamble of the memorandum of appeal and to correct the list of papers appended to the foot of the memorandum of appeal by two weeks from that date and in default directed the matter to be listed for final order.

Today, when the matter is called on, none has appeared on behalf of the appellant, nor any accommodation is prayed for. The department has reported that no application has been filed for acceptance of the deficit court fees put in out of time. In view thereof, the appeal stands dismissed as time barred and also for non-compliance of the order dated April 27, 2012. dns ( Uday Kumar, J. ) ( Soumen Sen, J. )
