Affidavit of service filed by the petitioners and the report submitted by the State are taken on record. Learned counsel for the petitioners submits that the petitioners being the owners of a portion of the plot in question are being restrained by the private respondents from cultivating the same.

Opposing the said contention, learned counsel for the private respondents submits that the private respondents are also recorded owners of a portion of the same plot. There appears to be a civil dispute between the parties which needs to be adjudicated by the appropriate forum.

With regard to the complaint lodged by the petitioners, it appears that a specific case has been started and investigation is in progress.

In view of the above, there is no necessity to continue with the present writ petition. The same is accordingly disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
