Learned counsel appearing on behalf of the petitioners submits that a sum was taken as fees for examination but the examination got postponed. Let the amount be adjusted with the fees that would be charged in future when the examination takes place.

Learned counsel appearing on behalf of the respondent Pharmacy Council of India submits that it is quite obvious that fees once paid for the examination would not go waste and would be adjusted against the fees for the examination postponed and to be held in future.

No further order need be passed in this regard because it has been admitted by the respondent Council that the fees paid would be adjusted for the examination that was postponed and would be held in future.

However, the question of what subjects would be taken up for examination is purely a matter of policy for the respondent authorities and would not be interfered with. With these observations, the writ petition is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
