Mr. Saqar Saha ..for the NCB Counter reply filed on behalf of the NCB is taken on record. Learned counsel appearing on behalf of the petitioner submits that there are no other materials available in the case diary, except for the statement of a co-accused.

Learned senior counsel appearing on behalf of the NCB opposes the prayer for anticipatory bail. He relies on the seizure list and submits that the contraband was seized from the house of the petitioner and another. Moreover, there are four criminal antecedents of the petitioner, two involving offences under the NDPS Act. Considering the above and the other materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.

The personal appearance of the Investigating Officer is noted and is dispensed with.
