Perused the office report dated 05.07.2023 and the solemn order dated 20.06.2023 passed by the Hon'ble Court.

In the said order, the Hon'ble Court has been pleased to direct interalia, "The learned Counsel for the appellant prays for an Adjournment.

The matter stands adjourned for two weeks in order to enable the appellant to remove the defects. In default, the matter may stand dismissed".

It appears from the said office report that in spite of the opportunity given by the Hon'ble Court, an application for condonation of delay has not yet been filed by the Ld. Advocate for the sole appellant. The department has placed the matter soliciting "Formal Order of Dismissal".

In view of the above circumstances, the appeal stands dismissed.
