Learned senior counsel appearing on behalf of the petitioners submits as follows. Although 26 persons were named in the FIR as the accused, only 16 were charge sheeted. Two of the prime accused are in custody and five were released on bail. A fight took place between two groups of villagers. There were case and counter case. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He refers to the statements of two other injured witnesses and the statements of other eyewitnesses as also to the injury report and the post mortem report.

Considering the incriminating materials available in the case diary and the alleged roles ascribed to the present petitioners, I do not consider this to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
