Affidavit of service filed by the petitioner is taken on record.

By the present writ petition the petitioner seeks for setting aside of the impugned order of transfer dated 12th September, 2025 issued by respondent no.6, Chairman, District Primary School Council, Murshidabad.

The petitioner contends that he is an Assistant Teacher who has been transferred from 42 Ekdala Primary School under Beldanga East Circle to 72, Joyrampur Primary School under Bhagawangola South Circle which is about 75 Kilometers away from his place of residence. The father of the petitioner is suffering from severe ailments and is bed ridden. On

18th September, 2025 the petitioner made a representation before the Chairman, District Primary School Council, Murshidabad seeking for redressal of his grievance. However, the same is still pending consideration. Hence this writ petition.

Mr. Anindya Bose, learned advocate appearing for the petitioner submits that after filing of the writ petition the petitioner has already joined his new place of posting i.e. 72, Joyrampur Primary School under Bhagawangola South Circle and as such the petitioner is not pressing his prayer for setting aside the order of transfer. However, he seeks that the representation be considered by the authority concerned.

Learned advocate appearing for District Primary School Council, Murshidabad as well as state respondents concede that the representation of the petitioner may be relegated to the appropriate authority for due consideration.

Since the petitioner does not press for setting aside of the transfer order, the writ petition being WPA 22937 of 2025 stands dismissed.

However, the respondent no.6, Chairman, District Primary School Council, Murshidabad is directed to consider the representation of the petitioner dated 18th September 2025 and dispose of the same by passing a reasoned order in accordance with law

upon notice to the petitioner within a period of eight weeks from the date of communication of this order. 8.

The reasoned order shall be communicated to the petitioner within one week from passing thereof. 9.

Learned advocate for the petitioner is directed to communicate this order to respondent no.6, Chairman, District Primary School Council, Murshidabad, for necessary compliance alongwith a copy of representation dated 18th September, 2025. 10.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

Interim order, if any, stands vacated.

12.

All connected applications, if any, stand disposed of. 13.

There shall be no order as to costs.

14.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

15.

Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
