During course of hearing, it is brought to the notice of this Court that though petitioner no. 2 namely Akramul Haque has affirmed the affidavit claiming that being the President of the Managing Committee of Jagatdal Shams Urdu High School he has been authorized by the Managing Committee to approach this Court with the present writ petition challenging the order of transfer dated 28th August, 2024, but on perusal of the resolution of the Managing Committee dated 3rd September, 2024, it does not appear that said Akramul Haque has been authorized by the Managing Committee of the said school to present this writ petition before this Court.

Posing query to learned advocate representing the petitioner, it is submitted that petitioner wants to withdraw the writ petition with liberty to file afresh on self-same cause of action.

Hence, writ petition stands dismissed as withdrawn with liberty to file afresh on self-same cause of action.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
