Neshaf ...for the Petitioner Mr. Aayush Sharma ...for CESC 25-09-2025 AKG Ct. 15 The petitioner submits that pursuant to an agreement for sale deed dated March 10, 2021, possession of a flat located on the third floor of the building at Holding No. 10/2, Narayan Chandra Sen Lane, P.S. - Golabari, Howrah, was handed over to her. However, the promoter of the building, Respondent No. 5, has been obstructing the officials of the Calcutta Electric Supply Corporation Limited (CESC) from providing an electricity connection to the said flat. Respondent No. 5 is not represented in these proceedings.
The affidavit of service filed by the petitioner is hereby retained on record.
The learned counsel appearing on behalf of CESC has acknowledged that the officials were impeded by Respondent No. 5 while conducting an inspection.
In light of the above, and considering that the petitioner is in settled possession of the flat in question, it is my view that the petitioner ought to be granted an electricity
connection irrespective of the ongoing dispute concerning the execution of the sale deed subsequent to the agreement for sale dated March 10, 2021.
Accordingly, I direct the officials of CESC to undertake a fresh inspection during the first week of November 2025. Following the inspection, if it is found feasible to provide the electricity connection, the same shall be extended to the petitioner within a period of two weeks thereafter. The Officer-in-Charge of Golabari Police Station is directed to provide necessary assistance to CESC officials to facilitate the implementation of this order. The petitioner shall bear the cost of such police assistance. Furthermore, the police are authorized to forcibly open the padlock of the meter room, if deemed necessary, to enable the connection. In the event that, for any technical or other reason, the electricity connection cannot be provided to the petitioner, the reasons shall be communicated to her forthwith. Accordingly, WPA 22991 of 2025 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
