CRR No. 4009 of 2024 In Re: Shakila Khatoon Mr. Mithun Mondal ... For the Petitioner Since the innocuous prayer of the petitioner is for expeditious disposal of M. Case no. 126/2022 under Section 125 of the Code of Criminal Procedure pending before the learned Judicial Magistrate, 1st Class, 3rd Court Sealdah, South 24 Parganas, the matter may be considered without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case. It appears that the proceeding was initiated on 6th August, 2022 and the prayer for interim maintenance filed by the petitioner is yet to be considered by the learned trial Court. The Court is informed that the next date of hearing has been fixed on 16th December, 2024.

In view of the above, the learned trial Court is directed to consider the prayer for interim maintenance filed by the petitioner on the next date of hearing fixed before him and dispose of the same within one month from the said date upon hearing both the parties, in accordance with law. Learned trial Court shall dispose of the case within six months from the date of granting interim maintenance to the petitioner in accordance with law. The revisional application is disposed of.
