1. Both the learned counsel appearing on behalf of the petitioners as well as opposite party are present.

2. This is a joint application filed by the petitioner as well as opposite party no.2 with a prayer for quashing the Complaint Case No. 75723/2022 on the ground of amicable settlement between the parties.

3. The revisional application originally filed with a prayer for setting aside the order dated 23.08.2022 passed by the Learned Chief Metropolitan Magistrate, Calcutta in connection with GR (S) Case No. 1245 of 2021, whereby Learned Chief Metropolitan Magistrate rejected the

prayer of the petitioner/ de facto complainant for further investigation of the case by the Officer-in-Charge of AntiFraud Section, Detective Department, Kolkata after submission of final report by the Investigating Officer.

4. Learned Chief Metropolitan Magistrate refused the prayer for further investigation and took cognizance of offence under Section 190(1) of the Cr. P.C. and treated the same as Complaint Case No. 75723/2022.

5. After hearing both sides as well as after considering the contents of the joint application filed by the parties, I find hardly any scope to stand in the way, and on the other hand continuation of this proceeding will be an abuse of process of Court.

6. In the aforesaid view of the matter, the Complaint Case being No. 75723/2022 presently pending before the 10th Court, Judicial Magistrate, Kolkata stands quashed.

7. With the aforesaid observation, the revisional application as well as connected applications stand disposed of.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings. 9.
