Matter relates to transfer of the petitioner being Librarian of a Government aided secondary school who applied on Utsashree Portal on 22nd February, 2022. The grievance of the petitioner is in spite of making application for transfer the said transfer application was not allowed by the respondent authorities. Petitioner prays for direction for consideration of his transfer application.

Having considered the submissions made on behalf of the parties it appears that post of Librarian in the school which is held by the petitioner is a single cadre post. In the event petitioner is transferred there is no

other staff in the school who can man the post of Librarian. In addition thereto even on consideration of the Government Notification dated 3rd January, 2022 issued by the Additional Secretary to the Government of West Bengal, School Education Department it appears that the local arrangement can also be not made since the issue relates to transfer of Librarian and the said notification dated 3rd January, 2022 is confined to teachers only.

In view of aforesaid no relief can be granted to the petitioner.

Accordingly, the writ petition stands dismissed. However this order shall not preclude the petitioner to make application for transfer in future in accordance with law.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
