Nandy Mr. Suman De .....for the State The revisional application was preferred challenging the proceedings relating to Shakespeare Sarani Police Station Case No. 111 of 2022 dated 13.06.2022 corresponding GR (S) Case No. 687 of 2022 pending before the learned Chief Metropolitan Magistrate, Caluctta.

Pursuant to the earlier order passed by this Court on 11th of October, 2022, Mr. Nandy appeared with the case diary. Mr. Mitter and Mr. Mazumder appears for the private opposite party.

There are allegations relating to certain misappropriation as well as signature and government stamp being forged. However, such allegations are subject to verification. The State was asked as to on how many occasions the investigating officer since the month of June, 2022 tried to arrest the petitioner. Mr. Nandy on instructions replied that once they had tried to arrest the petitioner but till date he could not be

arrested.

Having regard to the progress of the investigation and the fact that the accused is required for the sake of investigation, with a limited protection and I am inclined to dispose of the revisional application.

The petitioner will meet the investigating officer on 17th October, 2022 and subsequent dates as fixed by the investigating officer. No coercive steps should be taken against the petitioner till 23rd October, 2022.

The petitioner if so advised will exhaust his remedies in the meantime but will continue to meet the investigating officer on the date so fixed and all subsequent dates as the investigating officer feels necessary for appearance. No interference is made regarding the merits of the FIR which is subject matter of the case.

The investigating officer would be at liberty to exercise his powers in accordance with law on and from 24th October, 2022.

With the aforesaid observations, CRR 3853 of 2022 is disposed of.

Pending application, if any, is consequently disposed of. Parties shall act on a server copy of this order, duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
