The defendant in a suit for ejectment is the petitioner of the instant revisional application under Article 227 of the Constitution of India which is directed against order No.10 dated June 20, 2024 passed by the learned Chief Judge, Presidency Small Causes Court at Calcutta in the said suit being Ejectment Suit No. 394 of 2022. The learned Trial Judge by the order impugned has dismissed an application filed by the petitioner under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 (hereinafter referred to as "the said Act of 1997" in short) for non-compliance of the provision of Section 7(1) thereof.

The defendant by an application under Section 7(2) of the said Act of 1997 had prayed permission of the learned Trial Judge to deposit the arrear rents for the months of March, April and August 2022 which ought to have been

deposited under Section 7(1) of the said Act of 1997.

The learned Trial Judge therefore has rightly dismissed the said application, the order impugned does not call for any interference.

C.O. 3354 of 2024 is dismissed with the above terms without any order as to costs.
