Report submitted by the State is taken on record. The petitioner claims to be the owner of the plot in question and alleges that the private respondents are restraining him from entering into the property. Learned counsel for the private respondents submits that the property in question originally belonged to the predecessor in interest of the petitioner and the private respondents and the petitioner's father transferred the property to the predecessor of the private respondents by executing a deed of gift in 1977. The said deed was assailed by the petitioner before the civil Court in Title Suit no. 190 of 2001. The suit was dismissed on merits and miscellaneous case filed by the petitioner against the said order was also dismissed, meaning thereby, that the deed of gift is still subsisting. This fact has been suppressed by the petitioner before this Court.

The dispute is purely civil in nature. The petitioner is at liberty to approach the appropriate forum for redressal of his grievance.

However, the police authority is directed to keep strict vigil over the area so that no untoward incident takes place and there is no breach of peace and tranquility. With the above observation and direction the writ petition is disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
