No interference is called for in this revisional application. The learned District Judge at Alipore, South 24Parganas, has fixed the misc. appeal for hearing on consent of the parties. The learned Judge has also opined that if situation so arises that the misc. appeal should be disposed of upon hearing the other two applications, the same shall be done. Hence, no prejudice has been caused to the petitioner.

Under such circumstances, the learned Judge shall proceed with the hearing of the misc. case and in the event the court is of the view that the other applications are also required to be heard and disposed of, the same shall be done. This Court has not expressed any opinion on the merits of the applications which have been filed.

The revisional application is, thus, disposed of. There shall be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
