...for respondent no. 7 The petitioners were appointed as Samity Education Officers by the Panchayat Samities of Ghatal and Pingla in the district of Paschim Medinipur, with the responsibility of overseeing the Shishu Siksha Kendras (SSKs) and Madhyamik Siksha Kendras (MSKs) within the respective Panchayat Samities. Subsequently, these Siksha Kendras were brought under the administrative control of the State Education Department; however, the petitioners continue to be governed by the Panchayat Department.
By way of the present writ petition, the petitioners seek an inter-district transfer. The issue concerning the competent authority to effect such
transfer appears to be settled by the judgment of this Court in WPA 3120 of 2023 (Ashim Tarafdar & Ors. vs. The State of West Bengal & Ors.), wherein a coordinate Bench directed the Chief Secretary, Government of West Bengal, to nominate an officer to consider and decide the petitioner's application on its own merits.
Pursuant thereto, the Mission Director of the Paschimbanga Rajya Shishu Shiksha Mission was nominated by the Chief Secretary to consider the transfer application of a Samity Education Officer. In view of the aforesaid facts and circumstances, this writ petition is disposed of with a direction upon the Mission Director to consider and decide the transfer applications of the petitioners within a period of three months from the date of communication of this order, in accordance with law.
Accordingly, WPA 23528 of 2024 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
