The petitioner was appointed as a 'Junior Technical Officer' (Engg.) under West Bengal Comprehensive Area Development Corporation under the Panchayat and Rural Development Department in the year 1985, and retired from the said post on November 30, 2017.

It is an admitted position that during the entire service period, the petitioner was not given any promotion.

It appears that by Memo No.000/041/02/2019/117 dated January 16, 2020, the Finance Department of the State decided to accord notional promotion to some Junior Technical Officers to the post of Deputy Project Officer (non-functional) who retired in between December 1, 2016 and before December 31, 2019.

The petitioner claims that he ought to have been given the benefit of the said order dated January 16, 2020. His name, however, was not included in the list since his annual confidential report was not placed before the authority in due time.

It appears that the petitioner has made a representation before respondent no.4 for giving him the benefit of notional promotion as indicated above, but the same has not yet been considered.

In that view of this matter, this writ petition is disposed of with a direction upon respondent no.4 to consider the representation dated March 17, 2023, of the petitioner appearing at page 30 of the writ petition within a period of one month from the date of communication of this order. A reasoned order should be communicated to the petitioner within seven days thereafter.

With the above observations, WPA 22739 of 2023 is disposed of.
