07.11.2024 rc/ct.no.34 Item No.12 CRR No. 4018 of 2024 In the matter of : Arpita Das @ Arpita Das Aditya .......Petitioner Mr. Joy Chakraborty ...for the Petitioner Since the innocuous prayer of the petitioner is for expeditious disposal of her application for further investigation under Section 173(8) of the Code of Criminal Procedure in G.R.Case No. 7008 of 2018 pending before the learned Chief Judicial Magistrate, Howrah, the matter may be disposed of without service of notice upon the opposite party. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the matter.

It appears that upon submission of charge sheet by the Investigating Officer, the petitioner filed an application before the learned Trial Court under Section 173(8) of the Code for further investigation of the case. The application is pending since September 20, 2021.

In view of the above, the learned Trial Court is directed to consider and dispose of the application on the next date of hearing fixed before him, in accordance with law. In the event the learned Trial Court is unable to consider the application on the next date for cogent reasons, the application be disposed of within a month thereafter.

CRR No. 4018 of 2024 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
