Petitioner is aggrieved by the fact that the complaint case being Complaint Case No. 67363 of 2017 which is pending before the learned Metropolitan Magistrate, 11th court, Kolkata for six years for the purposes of cross-examination of PW-1 and the next date is fixed on 17th October, 2023.

Learned advocate submits that on different pretext the accused person is delaying the trial.

Having regard to the fact that the case is pending for the last eight years, I direct that on and from 17th October, 2023, the learned Magistrate would fix dates on each and every month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

All efforts be taken so that the prosecution evidence is concluded by February, 2024. The learned Magistrate would examine the accused under Section 313 of the Code of Criminal Procedure, grant opportunity for defence and try to dispose of the

case by 31st December, 2024.

With the aforesaid observations, the present revisional application being CRR 3662 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
