It is submitted on behalf of the petitioner that for reasons beyond their control, they were unable to be represented on 13.02.2026, when the matter was dismissed for default.

There are sufficient and cogent grounds made out as to why the petitioner was unrepresented on the date, then the matter was dismissed for default.

CAN 1 of 2026 stands allowed.

The order dated 13.02.2026 stands recalled.

WPA 23580 of 2024 By consent of the parties, WPA 23580 of 2024 is taken up for hearing.

The grievance of the petitioner is directed towards the failure of the WBSEDCL in shifting a low tension overhead pole from the land of the petitioner.

On behalf of the WBSEDCL, it is submitted that there are serious objection from the local authorities and despite making attempts there has been strong resistance.

In view of the submissions made on behalf of the parties, WPA 23580 of 2024 stands disposed of by directing the concerned District Magistrate having jurisdiction to consider the grievance of the petitioner after hearing all the affected parties including the WBSEDCL.

The above exercise is to be carried out within the period of eight weeks from the date of communication of this order.

It is made clear that there has been no expression on the merits of the case and all issues are left open for the concerned District Magistrate having jurisdiction to decide in accordance with law.
