1. Affidavit of service filed in Court today is taken on record.

2. The petitioner seeks refund of an overdrawn amount which he refunded while he was in service in the year 2008.

3. From the documents annexed to the writ petition, it appears that the petitioner retired from service in November, 2008. Pension Payment Order was issued in his favour in January, 2009.

4. The petitioner has approached this Court seeking refund of the amount paid by him by filing the writ petition on 20th September, 2005. There is no representation before the authority seeking refund of the amount paid. There is neither any averment in the writ petition explaining the delay in approaching the Court.

5. The Court is not convinced with the stand taken by the petitioner in approaching the Court at such a delayed point of time. The claim of the petitioner appears to be hopelessly time barred.

6. Accordingly, the writ petition fails and is hereby dismissed.
